  Ortho-McNeil Pharmaceutical Sued Over Ortho Evra Birth Control Patch

On November 10, 2005, Ortho McNeil, in conjunction with the FDA, issued a warning about the increased risks of blood clots associated with Ortho Evra. In the new warning, Ortho-McNeil admitted for the first time that women who use the patch will be exposed to up to 60% more estrogen than they would be exposed to if they were taking a birth control pill with 35 micrograms of estrogen. The patch is only intended to deliver 20 micrograms of estrogen. The FDA's announcement on this warning can be found at

Venous thrombosis is a blood clot formation in the veins that most commonly forms in the veins of the legs. The thrombus can interfere with circulation; it may break off and travel through the blood stream, which can cause pulmonary embolism or stroke. Treatment may include long term use of anticoagulant medications and/or surgery. The new warnings from the FDA and Ortho-McNeil indicate that the risk of developing blood clots may be significantly higher with the Ortho Evra patch than with oral contraceptives.

Stroke occurs when the blood supply to a part of the brain is suddenly interrupted. In brain tissue, a reduction of blood flow can damage or kill brain cells. Death of brain tissue can lead to loss of the function controlled by that tissue. Stroke is an extremely serious medical condition that often leads to adult disability and death. It is important to identify a stroke as early as possible because patients who are treated earlier are more likely to survive and have better recoveries. The new warnings from the FDA and Ortho-McNeil indicate that the risk of stroke may be significantly higher with the Ortho Evra patch than with oral contraceptives.

It is alleged that Ortho-McNeil was aware of the increased medical risks associated with Ortho Evra before the drug was approved and that, once approved, the company failed to adequately warn patients about these risks. Evidence shows that the risk of blood clots, heart attack and stroke associated with Ortho Evra is significantly higher than with oral contraceptive pills. The incidence of embolisms and thrombotic injuries in Phase III trials of Ortho Evra was reportedly six times greater than the incidence of such events in oral contraceptives using the hormone levonorgestral. The FDA has logged 9,116 reports of adverse reactions to the patch in a 17 month period, whereas Ortho Tri-Cyclen, a birth control pill, only generated 1,237 adverse reports in a six year period. During a 12 month period, 44 serious injuries or deaths have been associated with Ortho Evra, whereas only 17 such reports were linked to the birth control pill during a similar time period. The pattern is further magnified when usage rates are considered: Ortho Tri-Cyclen has six times the number of users as Ortho Evra.

Ortho Evra is an adhesive, transdermal birth control patch that is worn on the torso. The patch is intended to release 150 mcg of norelgestromin and 20 mcg of ethinyl estradiol into the bloodstream per 24 hours. It is replaced once a week for three weeks, and no patch is worn during the fourth week during menstruation. The regimen is then repeated. Ortho Evra was approved by the FDA in November 2001, and over 4 million women have used Ortho Evra since its approval. Ortho Evra continues to be marketed aggressively to both consumers and physicians.

  Asbestos Trust Fund Opposed By Mesothelioma Medical Experts

Mesothelioma Medical Experts Oppose Asbestos Trust Fund, Saying FAIR Act Hurts More than Helps

NEW YORK, Feb. 9 /PRNewswire/ -- The Doctor-Patient Alliance for Responsible Asbestos Policy today repeated its call on the U.S. Senate to cure fatal flaws in the proposed Asbestos Trust Fund bill (SB 852).

Last July, the nationwide group of 34 doctors who treat mesothelioma patients urged the U.S. Senate to remove the "one-size-fits-all" cap on awards and install a due process hearing, at which patients could prove their special medical and financial hardship damages and have their award tailored accordingly. The claims review system would be modeled after the 9/11 Victims Compensation Fund.

In addition, the Doctor-Patient Alliance asked for assurances that dying mesothelioma patients would be fairly compensated during their shortened life span. The detailed letter was sent to all 100 U.S. Senators.

"We are disappointed that our suggestions were ignored," said Dr. Harvey Pass, Chief of Thoracic Surgery at New York University Medical School. "This bill presented an historic opportunity to enact legitimate reforms that would directly benefit present and future meso patients. Regrettably, the bill actually hurts more than helps meso patients."

"The $1.1 million cap is insufficient to meet the medical, hospital, travel, lodging and other costs of mesothelioma patients who pursue the best treatments, which include surgery, chemotherapy, radiation, or a combination of therapies," said Dr. Robert Cameron, Chief of Thoracic Surgery at UCLA Medical School. "The inflexible cap fails to address the ongoing medical costs of patients who survive long enough to outlive the median survival time but who remain disabled and unable to earn a living. The bill ends up discriminating against the early stage, usually younger, patients whose life- long medical costs are certain to exceed their award.

"Mesothelioma must be treated as a chronic disease that requires a lifetime of care and treatment," said Dr. Cameron. "The costs of staying alive will far surpass the bill's arbitrary cap. Worse, some patients may decide against expensive novel treatments to stockpile the meager 'compensation' for their family."

In addition, the Alliance argues that any awards should be made while the money can be effectively invested in life-extending cures. "I doubt very much that the new bureaucracy will be up and running within my life time," predicts Dr. Bret Williams, age 52, a two year meso survivor who has incurred over $600,000 in medical bills. "It will take at least two years for the new federal agency to start paying out claims, while the median survival for mesothelioma patients is about nine months."

Dr. Williams, who has resolved his third-party civil claim, noted that most states have laws that allow in extremis meso patients to obtain preferential trial settings. For example, in Colorado and California, courts are required to set hardship meso cases for trial within 120 days. "I don't buy the rhetoric that an untested, under funded and at this point non-existent federal agency will pay out fair compensation faster than the court system," said Dr. Williams.

The Doctor-Patient Alliance has concerns that the bill will unduly restrict access to the Fund based on industry-friendly exposure criteria. "The Bill provides only for those with prolonged, occupational exposure. It excludes those with neighborhood exposure, or exposure only in schools or homes or while doing 'shade tree mechanic' work. It completely knocks out the first responders to the World Trade Center collapse," said Dr. Williams.

"My family would not have been compensated under the Trust Fund, since I was exposed while doing sporadic home repairs and while working with vermiculite potting soil," noted Dr. Williams.

"The U.S. Senate should correct these serious flaws or start over," said Dr. Pass. "Our government must do better when it comes to federal compensation initiatives. Recent studies of similar programs, like the Black Lung fund, make me skeptical that the asbestos trust fund will work. The motives may have been noble, but every federal compensation program to date has been marred by much higher costs, more claims than predicted, serious delays in meeting the demand and long intervals between the date the bill became law and the day the government started writing checks."

"I have a message for Dr. Frist," said Dr. Williams. "We belong to a privileged profession. Years ago, we dedicated ourselves to healing the sick, to caring for people from all occupations. It's been said that politics is 'medicine on a grand scale.' The principles guiding patient care should inform your decisions today. Let's ban asbestos. Let's fund research on effective treatments to stave off the asbestos health crisis. But let's not bail out industry at the expense of victims. Dr. Frist, do no harm."

“He sees some of the worse chronic pain patients in the world,” says Dr. Robins. “Most have been in pain for 10 to 30 years despite surgeries, epidural injections, and years of physical therapy. He teaches them that the cause of their pain is anger and that when they let go of the anger, their pain will disappear. He consistently produces a cure rate that’s close to 70 percent in terms of pain and function, and an additional 15 percent are much improved.”

Dr. Robins considers EFT the most effective, fastest-acting anger management technique available. “Like most doctors, I’m always in a hurry,” he says. “If I can teach EFT to a patient in just a few minutes and completely resolve not only chronic symptoms but their underlying cause, that’s terrific. In fact, it’s phenomenal. Nothing in the pharmaceutical world comes close.”

  Drugmaker Wyeth Hopes to Settle Fen-phen Lawsuits in Next Two Years
Wyeth Hoping to Settle Most Remaining "Fen-phen" Lawsuits in Next Two Years 
 
The chief financial officer of Wyeth expressed optimism on February 9th that tens of thousands of lawsuits by users of the recalled "fen-phen" diet drugs may be settled during the next year or two.
 
Pondimin (fenfluramine hydrochloride) and Redux (dexfenfluramine), the two drugs that made up the "fen" portion of what in the 1990s was the extraordinarily popular fen-phen diet drug combination, were pulled from the market on September 15, 1997.
 
Redux and Pondimin, when used in combination with phentermine (which remains on the market), allegedly caused heart-valve problems, primary pulmonary hypertension, and in some cases neurotoxic brain injury.
 
Even though the combined use of these drugs was never approved by the U.S. Food and Drug Administration, physicians were free to prescribe it.
 
After Redux and Pondimin were withdrawn, tens of thousands of lawsuits were filed against their manufacturer, American Home Products (later renamed Wyeth), by dieters who had used the drugs.
 
Now, almost a decade later, Kenneth J. Martin, executive vice president of Wyeth, told the annual Merrill Lynch Global Pharmaceutical Conference held in New York: "I think there is reason to believe that it (the litigation) could get wrapped up in the next 12 to 24 months.
 
"We have about $5.7 billion in remaining reserves, and based upon what we see today, we think that is adequate," Martin said. "Our expectation is that 80 percent of that could be paid out over the next 12 to 24 months."
 
He expressed confidence that the class action settlement could be "wrapped up as early as March," and if not, by sometime in the summer.
 
As for the 60,000 users of the diet drugs who opted out of the class action settlement, "we have settled with or reached agreement in principle to settle with a bit over 30,000 of the 60,000 plaintiffs," Martin said.
 
"Of the remaining 30,000, four law firms control 25,000 cases. We are in discussions with everybody. We are cautiously optimistic that we can reach agreement. If we do, that's fine. If we don't, we have been pretty successful in court. We are not averse to continuing to try cases, and if that's what it takes, that's what we'll do," Martin added.
 
But overall, he concluded, "I think there is reason to believe that it could get wrapped up in the next 12 to 24 months."

Indianapolis, IN (PRWEB) February 22, 2006--The Indiana Minority Health Coalition (IMHC), the state’s leading minority health research and community care agency, today launches its 2006 Indiana Minority Health Call to Action focusing on HIV/AIDS. The agency will offer several advocacy activities and rally statewide support of a new fund, “The HIV Gap Fund,” to offset increased changes in state and federal support.

The theme of this year’s initiative is “Think Global Act Local: a focus on HIV/AIDS.” IMHC, along with a planning group comprised of People Living with HIV and AIDS, public health leaders, elected officials, and faith, community and business leaders, will engage in advocacy and action days around the state culminating with a march from Monument Circle in Indianapolis to the Indiana State House on April 19, from 1 -3 p.m.; and the 12th annual initiative luncheon featuring an international celebrity, humanitarian and HIV/AIDS spokesperson on April 20 at The Westin Hotel, in downtown Indianapolis, from 11 am – 2 pm.

Since 1981 when the first cases were diagnosed, AIDS has killed more than 20 million people, in the minorities/ethnic communities, accounting for 40 percent of those deaths. In addition, in the United States racial/ethnic minorities account for more than 40 percent of the estimated 944,306 AIDS cases that have been diagnosed, making up 12.2 percent of the population.

To address this health concern, IMHC will work with community members to encourage them to take action within their counties. The organization is partnering with the 12 regions for the initiative, based on care coordination sites defined by the Indiana State Department of Health. Volunteers and participants in each region will receive HIV/AIDS Issues and Action Toolkits that will include current Indiana HIV/AIDS data and talking points that affect those infected and impacted; guide communities on developing their own local events; and develop methods to engaged elected officials such as the HIV/AIDS education day.

HIV/AIDS education is the priority for the initiative with the key message of getting support for the HIV Gap Fund to help save Hoosier lives. The fund is critical to Indiana residents who lack financial and social support resources. People living with HIV/AIDS and other life altering diseases are in a difficult position because they can not absorb the high cost of medications. Some HIV/AIDS medications alone range from $800-$1,250 per person per month.

The HIV Gap Fund will provide individuals with resource to help obtain their medication if they are faced with shortfalls in insurance, co-pays, spend downs or lack of social services.

“IMHC is dedicated to closing the gap in health care in our communities. We are rallying to save the lives of our loved ones, neighbors and co-workers. The HIV/AIDS education and advocacy activities from now through April are just our way of bringing awareness about this health epidemic and the action needed to prolong life right here in Indiana,” said IMHC CEO and President Nancy Jewell.

Avian Influenza: Significance of Mutations in the H5N1 Virus

GENEVA, Feb. 21 /Xinhua-PRNewswire/ -- Several recent media reports have included speculations about the significance of mutations in H5N1 avian influenza viruses. Some reports have suggested that the likelihood of another pandemic may have increased as a result of changes in the virus.

Since 1997, when the first human infections with the H5N1 avian influenza virus were documented, the virus has undergone a number of changes.

These changes have affected patterns of virus transmission and spread among domestic and wild birds. They have not, however, had any discernible impact on the disease in humans, including its modes of transmission. Human infections remain a rare event. The virus does not spread easily from birds to humans or readily from person to person.

Influenza viruses are inherently unstable. As these viruses lack a genetic proof-reading mechanism, small errors that occur when the virus copies itself go undetected and uncorrected. Specific mutations and evolution in influenza viruses cannot be predicted, making it difficult if not impossible to know if or when a virus such as H5N1 might acquire the properties needed to spread easily and sustainably among humans. This difficulty is increased by the present lack of understanding concerning which specific mutations would lead to increased transmissibility of the virus among humans.

Animal viruses

Virtually all the known subtypes of influenza A viruses circulate in some wild birds, most notably wild waterfowl. In these birds, different viruses constantly mingle with each other and frequently exchange genetic material, resulting in a huge pool of constantly changing viruses. Mutations and reassortment events are commonly observed in the affected bird populations.

In animals, some recent evolutionary changes in the H5N1 virus appear to have made control efforts more difficult and further international spread of the virus in birds more likely. Such changes are fully understandable, particularly in view of the exceptionally large number of birds that have been infected with the H5N1 virus and the frequent interactions between infected free-ranging poultry and wild waterfowl.

Studies have shown that H5N1 viruses from the current outbreaks, when compared with viruses from 1997 and 2003, have become progressively more lethal in experimentally infected chickens and mice, and are also hardier, surviving several days longer in the environment. Other studies have shown that the virus is not yet fully adapted to poultry and is continuing to evolve.

Domestic ducks have acquired an ability to resist the disease caused by some strains, and are now capable of excreting large quantities of highly pathogenic virus without showing the warning signs of illness. In endemic countries, this altered role of domestic ducks is now thought to contribute to perpetuation of the transmission cycle. Research conducted in South-east Asia has recently shown that multiple distinct lineages of H5N1 virus have become established in poultry in different geographical regions, indicating the long- term endemicity of the virus in parts of Asia. That research also detected highly pathogenic H5N1 virus in apparently healthy migratory birds.

In birds, one important recent finding has been the remarkable similarity of viruses from recent outbreaks to those isolated from migratory birds that began dying at the Qinghai Lake nature reserve in central China in late April 2005. Evidence is mounting that this event, which resulted in the deaths of more than 6,000 wild birds, signalled an important change in the way the virus interacts with its natural reservoir host.

Unlike the case with mutations of human viruses (some of which have been transient), it appears that some changes have become fixed in viruses circulating in at least some species of wild birds.

Prior to the Qinghai Lake event, the highly pathogenic H5N1 virus was known to cause occasional sporadic deaths in migratory waterfowl, but not to kill them in large numbers or be carried by them over long distances.

Viruses from Qinghai Lake showed a distinctive mutation at one site experimentally associated with greater lethality in birds and mice. Viruses from the most recent outbreaks, in Nigeria, Iraq, and Turkey, as well as from earlier outbreaks in Russia, Kazakhstan, and Mongolia, are virtually identical to Qinghai Lake viruses.

It is considered unusual for an avian influenza virus causing outbreaks in birds to remain this genetically stable over so many months. This finding raises the possibility that the virus -- in its highly pathogenic form -- has now adapted to at least some species of migratory waterfowl and is co-existing with these birds in evolutionary equilibrium, causing no apparent harm, and travelling with these birds along their migratory routes.

If further research verifies this hypothesis, re-introduction of the virus or spread to new geographical areas can be anticipated when migratory birds begin returning to their breeding areas.

The recent appearance of the virus in birds in a rapidly growing number of countries is of public health concern, as it expands opportunities for human exposures and infections to occur. These opportunities increase when the virus spreads from wild to domestic birds, especially when these birds are kept as backyard flocks in close proximity to humans.

To date, no human cases have been linked to exposure to wild birds. Close contact with infected poultry and other domestic birds remains the most important source of human infections.

Human viruses

Some mutations have been detected in human viruses isolated in 2005 and, most recently, in one virus isolated from a fatal case in the January 2006 outbreak in Turkey. Although these mutations were found at the receptor- binding site and involved the substitution of more mammalian-like amino acids, the effect of these changes on transmissibility of the virus, either from birds to humans or from one person to another, is not fully understood. Moreover, recent studies show that these mutations were transient and did not become fixed in the circulating viruses.

Scientists do not presently know which specific mutations are needed to make the H5N1 virus easily and sustainably transmissible among humans. For example, it is not known whether the absence of a specific receptor in humans for this purely avian virus is responsible for the present lack of efficient human-to-human transmission. For this reason, virological evidence of mutational changes must be assessed together with epidemiological information about transmission patterns actually occurring in human populations. This necessity further underscores the importance of close surveillance and thorough investigation during every outbreak involving human cases.

Assessments of the outbreak in Turkey, conducted by WHO investigative teams, have produced no convincing evidence that mutations have altered the epidemiology of the disease in humans, which was similar to the pattern consistently seen in affected parts of Asia. There is no evidence, at present, from any outbreak site that the virus has increased its ability to spread easily from one person to another.

When Roney Jr. purchased the products, they were advertised as natural occurring supplements that came from Scottish pine trees. After taking the product, Roney has suffered from endocrine imbalance and testosterone deficiency. He suffers from feelings of despair, lack of energy and had lost over 45 pounds. “Other people are at risk, and I have come forward due to a concern for others who may be in danger.” said Roney Jr. “Taking this product has caused serious problems. I never would have taken them if I had any idea something like this would happen.”

“If there is a substantial risk of harm to people, we should put a spotlight on it, explained Chicago product liability lawyer Todd Smith, “The law is you have to make a product reasonably safe and fully inform the consumer about any risk. It was clear the manufacturer was not policing themselves and not informing the public of risks.”

The case, #06L25, was filed in the Circuit Court for the 6th Judicial Circuit of Illinois, Champaign County.

WHY ORGANIC: When products are applied directly to the body, up to 60% of the compounds in the product are absorbed into the skin, including any toxic ingredients. Phthalates: An industrial chemical very commonly found in consumer cosmetics. Linked to lung, liver and kidney damage and birth defects in the male reproductive system. A recent study by the EWG tested 72 name brand, off the shelf beauty products for the presence of phthalates. The lab found phthalates in 52 of the 72 products tested (72%) although only one listed phthalates on the label. 

Parabens: The most commonly used preservatives in consumer cosmetics. Parabens (usually listed by one of their compound names, such as methylparaben, propylparaben, etc.) readily penetrate the skin and, according to the Women’s Environmental Network (WEN), research indicates that they can act as estrogen mimics, disrupting normal biological and reproductive functions. Numerous studies have also linked parabens to breast cancer, prompting the Campaign for Safe Cosmetics (www.safecosmetics.org) to request that cosmetic manufacturers voluntarily discontinue the use of these preservatives. 

Ultrafine Particles (UFPs): Found in a number of newer cosmetics, including some sunscreen preparations which incorporate nanoparticle titanium dioxide. These UFPs have demonstrated toxicity and according to Dr. Vyvyan Howard, a toxicologist at Liverpool University, can enter the lymphatic system via the skin.

FDA Seizures of Canadian Drugs Unnecessarily Endangering U.S. Patients

Recent interdictions of Canadian drug packages by U.S. Customs agents are part of a calculated campaign to intimidate patients who order life-saving medications from licensed online Canadian Pharmacies. Interruptions in established medical therapy are putting patients at unnecessary risk.

Calgary, Canada (PRWEB) February 13, 2006 -- The U.S. FDA has been ramping-up interdictions of Canadian drug packages in what appears to be an intentional intimidation campaign timed to coincide with the launch of the controversial Medicare Part D prescription drug program. Seizure rates at major border entry points have increased nearly ten-fold since December and are accompanied by a letter that obviously intends to frighten patients. Evidence that recent seizures are part of a deliberate “operation” is substantiated by Mark Conrad, a retired U.S. Customs special agent, after he was contacted by an anonymous whistleblower in Miami alerting him than an intentional seizure program was underway. Officials from Customs and Border Protection’s public affairs office in South Florida did not return a phone call seeking comment on the operation.

"It's an issue of patient safety," says Andy Troszok, CIPA President. "We're not talking about Viagra and narcotics abuse. Who is going to be liable for these people going off medical regimens and suffering or even dying?"

New Online Journal Explores Medicinal Plants and Traditional Medicine

Trees for Life Journal: A forum on beneficial trees and plants will be a free, open access electronic forum, to bring together international articles about traditional medicine, small-scale field studies and scientific evidence regarding natural remedies and medicinal plants that could benefit humanity. “Our journal aims to bridge the gap between grassroots knowledge and scientific research,” Mathur said. “By publishing formal and informal studies on medicinal plants and trees and the resulting herbal remedies, we hope to advance the use of these vital resources worldwide.”

Trees for Life is a non-profit organization that helps plant fruit trees in developing countries as a low-cost, self-renewing food source. The movement’s philosophy of “education, health and environment” will be evident in Trees for Life Journal, which aims to expand global knowledge about the medical and nutritional value of plants in order to educate citizens of third world countries.

The idea for the journal was born from traditional claims about the nutritional, medicinal and other beneficial properties of the tree Moringa oleifera. Every part of the tree is edible or used as traditional medicine, from the leaves to the bark to the seeds. It grows wild in poor soil and provides vitamins desperately lacking in diets of impoverished people. Trees for Life recognized the need for a forum to publish and discuss scientific studies and communal knowledge of this tree, in order to promote its cultivation in the developing world. The inaugural issue of the journal includes a review of the medical evidence for Moringa’s potential.

“People whose lives could be improved by research findings are not even aware such a wealth of information exists in their midst,” said Mathur. “Almost anyone with experience would agree that many more channels of communication are needed to increase the exchange between academics and lay people.”

Trees for Life Journal will be free to users and features an easy-to-use format. Anyone may publish an article—from peer-reviewed field and clinical studies to informal essays or ideas for possible new uses of medicinal plants and trees. The content is also freely available for reproduction and distribution, with credit given to the original authors. The Web site also features a mentor program that matches experienced scientists with those who are new to the research process. Publishing electronically means the journal can be updated as often as necessary.

Support Grows for Ban on Male Circumcision

Bill proposals to regulate male circumcision now circulating in Congress and fifteen U.S. state legislatures.

San Diego, CA (PRWEB) February 7, 2006 -- John Soemer from New Jersey remembers the moment when he learned that a part of his penis was missing as if it were yesterday. “I am now 61 years old, but I was in fifth grade when I first found out I was circumcised,” recalled John. “I had seen an intact friend's penis when he relieved himself while we were out fishing, and when I asked him why his looked so different, he told me what had been done to me. Back then neither one of us knew the proper name for any of those parts, so he called his foreskin his ‘funskin’. That gave me enough of an idea that I was missing out on something, and left me feeling very cheated.”
   
John is not the only circumcised man who feels that he was robbed of his right to an intact body. While thousands of men are taking up foreskin restoration to reverse some of their circumcision damage, others are working with human rights groups to stop circumcision from being forced onto infants and children. Today, John and a group of activists from fifteen states joined this movement when they participated in the Third Annual USA MGM (Male Genital Mutilation) Bill Submission. Together they submitted letters and bill proposals via fax, email, postal mail, and hand delivery to more than 2,700 federal and state legislators in a single day – up from 660 legislators the year before. The proposed legislation, written by San Diego based MGMbill.org, would make current U.S. female genital mutilation laws gender neutral so that boys are legally protected from circumcision the same way that girls are protected.

Matthew Hess, President of MGMbill.org, said that infant circumcision is sexual assault. “Male circumcision permanently damages male sexual function, and it is done forcefully, without the consent of the child. Just as cutting off any part of a baby girl’s genital anatomy would be considered a criminal act, amputation of a boy’s foreskin for medically unnecessary reasons should be treated as a crime of equal stature. If a fully informed adult wants to undergo circumcision for cosmetic, religious, or other personal reasons, then that is a decision he can make after he turns eighteen.”

Chaz Antonelli of Quincy, Massachusetts, took a day off from work to hand out copies of the MGM Bill proposal to legislators at the State House in Boston. Like most American men born in the 1960’s, Chaz was routinely circumcised as an infant in a hospital. “As a newborn baby, I could not protect myself from being circumcised,” said Chaz. “While I support an adult’s right to alter his or her own genitals if that is their preference, forcing circumcision onto a helpless child is a clear human rights violation. I’m here today because I want Massachusetts to be the first U.S. state to ban routine infant male circumcision.”
   
Male circumcision legislation is also becoming a topic of discussion in several European parliaments. Sweden became the first developed country in modern times to regulate and restrict male circumcision on human rights grounds in 2001, and in 2003 the Denmark National Council for Children called on lawmakers to ban the practice for the benefit of the children. In 2004, well-known Dutch Member of Parliament Ayaan Hirsi Ali called on fellow legislators to enact a similar ban, and she recently stated on a Dutch television documentary that male circumcision is “a form of mutilation” and that “the consequences can be worse for boys than for girls” when compared to some common types of female circumcision.

In addition to all 540 members of Congress, state legislatures that received MGM Bill proposals from their local residents today included California, Florida, Louisiana, Maryland, Massachusetts, Missouri, Nebraska, New Jersey, New York, North Carolina, Oregon, South Carolina, Tennessee, Utah, and Virginia.

Many victims will die of cardiac failure or pneumonia and are never diagnosed with an asbestos related disease.

No Asbestos Ban?

In 1989, the EPA announced an asbestos ban and phase out. But in 1990, the ban was overturned by a U.S. Circuit Court of Appeals. “So we don't have an actual ban on asbestos, but instead a regulation to reduce exposure,” said Reinstein. “Asbestos is allowed in certain concentrations. For example, under OSHA, an employee cannot be exposed to more than 0.1 asbestos fibers per cubic centimeter of air for an average eight hour work day. But, this gets confusing because how does a consumer know if a given product fits within those guidelines?” According to Reinstein these regulations may not even matter because the EPA has repeatedly stated that there is no safe level of asbestos exposure.

In addition to having asbestos present in new products and materials, an estimated 30 million homes, schools and offices are already contaminated with the mineral. So construction, repair, or demolition in older structures can lead to exposure as we saw on 9/11 with the World Trade Center. “One life lost to an asbestos related disease is tragic; hundreds of thousands of lives lost is unconscionable. While we can't reclaim the lives of our loved ones, we can make the world a better place for those who come after us.” Reinstein concluded.

The fentanyl patch is comprised of an outer impermeable plastic shell and a drug permeable inner lining. The patch is applied directly to the skin where heat from the body activates a regular release of fentanyl over a 72 hour period. This drug is a powerful opiate pain-reliever held in a gel suspension between the two linings of the patch. The inner lining only lets a certain amount of the drug into the body based on the needs of the patient, typically between 25 to 100 micrograms per hour.  Sales of Duragesic earned Janssen Pharmaceutica over a billion dollars between the year 2002-2003. Unfortunately a problem in the seal between the linings was discovered in February 2004, prompting Janssen to initially recall one group of the patches, but an additional four groups of the patch were removed from the market later in April.  The company has since recalled over two million of the patches.
 
Bagolie Friedman Injury Lawyers, with affiliate offices in Jersey City and Clifton New Jersey, Hollywood Florida and Brisbane, Australia, have begun to review and accept injury cases from surviving family members and individuals who have suffered from Fentanyl overdose. Duragesic is no longer the only fentanyl pain patch being marketed. On January 28, 2005, the U.S. Food and Drug Administration (FDA) granted final approval for Mylan Laboratories, Inc. to market a generic fentanyl transdermal system. The manufacturer of Duragesic® has also begun to market an authorized generic version of the fentanyl patch through an agreement with Sandoz. Other generic companies have applications pending at the FDA to market similar fentanyl patches, therefore, other generic versions may soon be available. Problems associated with these newer generic patches have also been reported.  "It is very difficult for a person examining a fentanyl patch to detect a defect or leak. This can lead to a dangerous situation as exposure to an excessive amount of fentanyl can lead to serious injury or death." says attorney Alan Friedman.
